BEFORE HONOURABLE MR. JUSTICE PARTHIVJYOTI SAIKIA ORDER Date : 25.05.2026 Heard Mr. B Kakati, the learned counsel appearing for the petitioner as well as Mr. P Borthakur, the learned Additional Public Prosecutor appearing for the State of Assam.
2. This is an application under Section 482 of the BNSS, 2023, whereby the petitioner, namely, Baloram Das has prayed for grant of pre-arrest bail in respect of Goreswar P.S. Case No. 53/2025.

3. One night the father of a Muslim girl noticed that his daughter went out of the house and she was picked up by some young persons. Later on, it was discovered that the said Muslim girl fell in love with a Hindu boy. They continued with the relationship for a period of one and half years. On the day of occurrence, the girl had gone with him to get married. The girl insisted the petitioner to convert to Islam but he did not do so. Therefore, their marriage did not take place, though they had physical relationship.
4. I have gone through the statements of the victim girl recorded under Section 183 of the BNS, 2023.
5. The girl was aged about 20 years at the time of occurrence.
6. After considering all the aforesaid facts and after considering the submissions made by the learned counsel of both sides, this Court is of the opinion that for the aforesaid offence, the petitioner does not deserve to be detained in custody.
7. Therefore, the anticipatory bail application of the petitioner is allowed.
8. It is hereby directed that in the event of arrest in connection with Goreswar P.S. Case No. 53/2025, the petitioner, Baloram Das shall be released on bail of ₹25,000/- with a surety of like amount to the satisfaction of the arresting authority.
9. The petitioner shall co-operate with the police Investigating Officer as and when called for.
10. With the aforesaid direction, the anticipatory bail application stands disposed of. JUDGE Comparing Assistant
