Page No.# 2/2 By this application, the petitioners have prayed that the condition imposed upon them to pay costs of Rs. 15,000/- in the event the counter affidavit is not brought on record by 25.02.2026 in WP(C) Nos. 3106/2023 and 4868/2023 be modified/altered or condoned. The learned Senior Counsel submitted that the affidavit had already been presented for filing on 25.02.2026, but could not be brought on record due to certain procedural requirements in the Registry remaining to be complied with. Accordingly, this Court is of the opinion that since steps had already been taken by the applicants to have the affidavit brought on record on or before 25.02.2026, therefore the condition imposing costs of Rs. 15,000/- upon the applicants is required to be recalled.
