JUSTICE SACHIN SHANKAR MAGADUM ORAL ORDER The petitioner has instituted the present writ petition seeking issuance of a writ in the nature of mandamus directing respondent No.4 to consider and act upon the complaint dated 10.12.2025, produced at Annexure–E, - 3 - HC-KAR NC: 2026:KHC:16866 WP No. 38156 of 2025 and to register a criminal case against respondent No.5 in accordance with law. 2. Learned counsel appearing for the petitioner, reiterating the grounds urged in the writ petition, would vehemently contend that despite the petitioner furnishing relevant material, including medical records and Medico- Legal Certificates (MLCs) appended to the writ papers, respondent No.4 has failed to discharge his statutory duty of registering a First Information Report. It is further contended that such inaction on the part of respondent No.4 is arbitrary and contrary to the settled principles governing registration of FIR, particularly when the complaint discloses cognizable offences. Learned counsel would also submit that respondent No.5, being a practicing Advocate, is attempting to misuse his position, thereby necessitating prompt police action. 3. Per contra, learned Additional Government Advocate, on instructions, submits that there is no - 4 - HC-KAR NC: 2026:KHC:16866 WP No. 38156 of 2025 deliberate inaction on the part of respondent No.4. He would submit that the Station House Officer is ready and willing to proceed in accordance with law on the basis of the complaint submitted by the petitioner. However, despite repeated requests and communications, the petitioner has not cooperated with the jurisdictional police by furnishing further particulars and has failed to appear before the Station House Officer for the purpose of facilitating necessary enquiry. It is therefore contended that appropriate directions may be issued to the petitioner to extend cooperation to the investigating machinery. 4. In light of the submissions made by the learned counsel appearing on both sides and taking into consideration the material placed on record, this Court deems it appropriate to dispose of the petition with the following directions: - 5 - HC-KAR NC: 2026:KHC:16866 WP No. 38156 of 2025 ORDER (i) The writ petition is allowed; (ii) The petitioner is directed to appear before respondent No.4 – Station House Officer, within a period to be stipulated by the said authority, and furnish all necessary information and documents in support of the complaint dated 10.12.2025; (iii) Upon such appearance and cooperation by the petitioner, respondent No.4 shall consider the complaint in accordance with law and take appropriate action, including registration of a case, if the complaint discloses commission of cognizable offence, and thereafter proceed in accordance with law.
