Mr. Deepak Bhatt, Advocate for the petitioner. Mr. S.K. Nailwal, Standing Counsel for the State. 2. By means of this writ petition, petitioner has sought the following reliefs: “a) To issue a writ order or direction in the nature of "certiorari" quashing the order dated 29.03.2022 passed by the Addl. Collector (Finance and Revenue) District Udham Singh Nagar in case no. 52/120 of 2017 by which the learned Addl. Collector (Finance and Revenue) has imposed a royalty of Rs. 7,23,800/- upon the petitioner (contained as Annexure no. 1 to this petition) b) To issue a writ order or direction in the nature of "certiorari" quashing the order dated 07.12.2022 passed by Commissioner Kumaon Division Nainital in appeal no. 173/(2021-2022) (contained as Annexure no. 2 to this petition) by which the appeal filed by the petitioner has been dismissed. c) To issue a writ order or direction in the nature of "certiorari" quashing the order of recovery dated 02.08.2022 passed by the respondent no. 3 as well as the letter of citation issued by the respondent no. 4 dated 29.08.2022 (Annexure no. 3 & 4 to this petition) d) Issue a writ order or direction in the nature of mandamus commanding the respondents not to make any recovery from the petitioner in pursuance to the order dated 29.03.2022 passed by the Addl. Collector (Finance and Revenue) District Udham Singh Nagar in case no. 52/120 of 2017.” 3. Today, matter is listed on Withdrawal Application (IA/6/2026). 4. Learned counsel for the petitioner submits that petitioner do not want to pursue 2026:UHC:4906 the matter any further, therefore he has sought permission to withdraw the writ petition. 5. Permission granted. 6. Withdrawal Application is allowed. 7. The writ petition is dismissed as withdrawn. 8. The amount deposited by petitioner in the Registry of this Court pursuant to order dated 17.04.2023, shall be released in favour of petitioner within 15 days.
