CORAM : URMILA JOSHI-PHALKE AND RAJ D. WAKODE, JJ. DATE : 08.09.2026 Heard Ms. Kavi, the learned counsel for the petitioner. 2. The learned counsel for the petitioner has invited our attention to the order dated 27.07.2026 passed by this Court in Writ Petition No.5682 of 2026 and submits that the respondent – Committee, in spite of specific directions given by this Court for deciding the caste claim of the petitioner within one month from the date of the order i.e. 27.07.2026, has not decided the caste claim of the petitioner. 3. The perusal of the entire petition including the annexures and pleadings reveals that the petitioner has Prity 2 / 2 107.cp352.2026 not issued the legal notice pointing out such willful and deliberate contempt on the part of the present contemnors Nos.1 to 4. The officers of the respondent – Committee are made party respondents in personal capacity as they will be required to face the punishment of imprisonment if ultimately this Court comes to a conclusion that there is a willful and deliberate contempt on the part of the present contemnors. However, the petitioner has not issued any legal notice to them in their personal capacity pointing out such contempt and directly has filed the present contempt petition. 4. In view of above, Ms. Kavi, learned counsel for the petitioner, on instructions, submits that she will withdraw the present contempt petition and then will issue notice to the respondents/contemnor pointing out such contempt. If the contemnors do not obey the order of this Court even after receipt of the contempt notice, the petitioner shall always be at liberty to approach this Court in a contempt jurisdiction. 5.
