3. By means of this writ petition, petitioner has sought the following reliefs:-
“i. A writ, order or direction in nature of Mandamus commanding the respondent no. 1 and 2 to decide the representation of the petitioner dated
26.08.2016.
ii. A writ, order or direction in nature of Manamus commanding the respondent no. 1 and 2 to implement the order dated 27-08-2016 and order dated 28-10-2016 and order dated 28-04-2018 and
order dated 10-03-2015 passed by the S.O.C. (Settlement Officer Consolidation, Roorkee, District Haridwar, State Uttarakhand).”

Learned State Counsel refers to para 5 of the short counter affidavit filed by Mr. Diwan Singh Negi, Settlement Officer, Consolidation, Roorkee, District Haridwar, where it is stated that on the request made by petitioner for measurement and demarcation of chaks, respondent no. 2 constituted a joint team comprising Chakbandi Officer, Assistant Chakbandi Officer, Chakbandikarta, Chakbandi Lekhpal etc., who after elaborate survey and inspection presented their report dated
01.03.2018. It is further mentioned that declaration under Section 52 of Consolidation of Holdings Act, 1953 was
2026:UHC:4905 published on 02.09.2016 and thereafter the consolidation operation has come to an end and the concerned officers of the Consolidation Department have become functus officio.
5. This Court finds substance in the stand taken in the short counter affidavit. After closure of consolidation proceedings and issuance of notification under Section 52 of the Act, Consolidation Authorities do not have any authority to pass any order in the matter.
6. The writ petition is, therefore,
disposed of with liberty to petitioner to approach the District Magistrate, if he has any pending grievance. If petitioner makes representation, decision thereupon shall be taken, as per law, within ten weeks.
