JUSTICE TARA VITASTA GANJU ORAL JUDGMENT (PER: HON'BLE MRS. JUSTICE ANU SIVARAMAN) This appeal is preferred against the judgment and decree of the I Addl. City Civil & Sessions Judge, Bengaluru (CCH No.2) in O.S.No.2557/2013 dated 09.07.2024, by which the suit filed for cancellation of Sale Deed has been dismissed. 2. It is submitted by the learned counsel on either side that the parties have now reached a compromise and that a deed of cancellation of sale deed dated 13.08.2025 - 3 - HC-KAR NC: 2026:KHC:16550-DB RFA No. 2236 of 2024 which has been executed on 14.08.2025 is also presented before this Court today. 3. The parties are also present before the Court and are identified by their respective counsels. 4. It is further submitted that the compromise entered into between the parties may be recorded and that the appeal may be disposed of setting aside the judgment and decree by recording the compromise and the cancellation deed entered into between the parties. 5. The terms of compromise reads as under: "03. That in pursuance of the said settlement, the respondent and her sons who are confirming witnesses had executed a Deed of cancellation of sale deed on 14.08.2025 vide document No.BHM-1-04109/2025-26 Book No.1 before the Sub-registrar Jayanagar (Bommanahalli) Bangalore, whereby canceling the sale deed dated 21.05.2008 registered as document No.948/2007-08 whereby respondent has released her rights, title and interest over the suit schedule property in favour of the appellant herein by confirming rights, title and interest of the appellant herein. Thus, the appellant herein became the absolute owner in possession of the suit schedule property. - 4 - HC-KAR NC: 2026:KHC:16550-DB RFA No. 2236 of 2024 04. That the parties have now resolved all their disputes fully and finally and there is nothing more left to be adjudicated. 05. That the both the parties undertakes and prays this Hon'ble Court may be please to handover all the original and certified copies of the documents pertaining to the suit schedule property produced by her in the trial court to the respondent. 06. That the present compromise is voluntary, without any coercion, undue influence, or misrepresentation, and both parties are bound by its terms." 6. Having considered the contentions advanced and in view of the compromise entered into between the parties as well as the cancellation deed dated 13.08.2025 executed between the parties, which is also on record, the RFA is disposed of in terms of compromise. The judgment and decree dated 09.07.2024 passed by the I Addl. City Civil & Sessions Judge, Bengaluru (CCH No.2) in O.S.No.2557/2013 is set aside. 7.
