Ajay Mohan Goel, Judge (Oral) By way of this writ petition, the petitioner has, inter alia, prayed for the following reliefs:- “i) Issue a writ of Mandamus Or other appropriate writ order or direction, directing the respondents corporation to consider the case of the petitioner for regularization after completion of one year of contractual service w.e.f. 1993 as Chowkidar with all consequential benefits. ii) Issue a writ of Mandamus Or other appropriate writ 1Whether reporters of the local papers may be allowed to see the judgment? 2 2026:HHC:7403-DB order or direction, directing the respondents corporation to re-fix the pay of the petitioner and release the same in favour of petitioner within time bound manner. iii) In alternative in case the petitioner is considered part time employees, than issue a writ of Mandamus Or other appropriate writ order or direction, directing the respondents corporation to consider the case of the petitioner for regularization after completion of eight years of part time service as done in the case of similar situated persons case with all consequential benefits and eligible benefits may also ordered to be released in favour of the petitioner within time bound manner.” 2. The parties are ad idem that the issue raised by the petitioner is covered by the judgment of Hon’ble Division Bench of this Court in CWPOA No. 5730 of 2020, titled Hem Chand Vs. Himachal Road Transport Corporation, along-with other connected matters, decided on 26.05.2025. 3. Accordingly, this petition is disposed of with the observation that the judgment passed by the Hon’ble Division Bench of this Court in Hem Chand Vs. Himachal Road Transport Corporation (supra), shall be construed to have been passed in the present writ petition also and all benefits 3 2026:HHC:7403-DB which have been conferred upon the petitioners therein, be conferred upon the petitioner herein also. It is clarified that in case, the implementation of the judgment results in any monetary benefits to the petitioner, then the same shall be notional, as from the due date up to three years from the date of the filing of the writ petition, from when the petitioner shall be given actual benefits. 4.
