Heard learned counsel for the petitioner and learned counsel for the State.
2. The petitioner is apprehending his arrest in connection with Bengabad P.S. Case No. 136 of 2025, registered for the offence under Sections 135 and 138 of the Indian Electricity Act, pending in the court of learned Special Judge, Electricity Act-cum- Additional Sessions Judge-IX, Giridih.

Learned counsel appearing for the petitioner submits allegation is made that the petitioner has utilized the electricity to the tune of Rs.71,820/- without any proper connection and the said allegation is not correct. He further submits that the petitioner has taken instruction at the time of furnishing bail bond, the petitioner will deposit 25% of the said amount to JUVNL, Giridih. He next submits that he will pay further 25% of the said amount within three months.

Learned counsel appearing for the State and JUVNL have jointly opposed the prayer and submits that the petitioner is require to deposit entire amount.

In view of above and considering that the allegation is there of pilferage electricity to the tune of Rs.71,820/- and the petitioner is ready to pay 25% of the said amount to the JUVNL, Giridih at the time of furnishing bail bond and further 25% of the said amount within three months, and in that view of the matter, the petitioner, named above, is directed to surrender before the learned Court within two weeks from today and the learned Court shall accept the bail bond on showing receipt of paying 25% of the said amount in favour of JUVNL, Giridih and thereafter shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
