At the outset learned Counsel for the applicant submits that, initially, the victim had not given her consent for a DNA test of the fetus. However, at later point of time, the victim gave her consent and due date of delivery is 07.10.2026. 3. In this view of the matter, learned Counsel for the applicant submits that he will wait until that DNA report is received. Therefore, he seeks permission to withdraw the present application with liberty to file a fresh application before the Trial Court as soon as the DNA report of the fetus is received. 4.
