Rabindra Nath Basak, Adv. Debleena Dasgupta, …for the State. Affidavit of service filed by the petitioner is taken on record. None appears for the Panchayat despite service. Learned counsel for the petitioner submits that the petitioner intends to raise construction in the property purchased by him and has submitted an application in prescribed form before the Pradhan, Amrasota Gram Panchayat, being the 3rd respondent herein, seeking sanction of building plan. The application has not been responded to. However it is not clear whether the application has been delivered to the 3rd respondent. On prayer of the petitioner, liberty is granted to submit a fresh application before the 3rd respondent seeking sanction of building plan for raising construction in the plot in question within seven days from date. The 3rd respondent is directed to consider and dispose of the application within four weeks from the date of receipt thereof upon granting reasonable opportunity of hearing to 2 all concerned including the petitioner, in accordance with law. The decision taken by the authority shall be communicated to the petitioner within a week thereof. The writ petition is accordingly disposed of. There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted.
