2. This is an application under Section 528 of the BNSS, 2023 in respect of PRC Case No.12/2020 pending in the Court of the learned Sub-Divisional Judicial Magistrate (Sadar), Lakhimpur, North Lakhimpur.
3. The petitioner Raju Panika is an accused before the trial court. After filing of the charge sheet, notice was issued to him, but the same was not served. Therefore, the trial court directed issue of Non-Bailable Warrant of Arrest against the present petitioner and the abovementioned case was filed against him.
4. I have considered the submissions made by the learned counsel of both sides.
5. Since the petitioner is interested in facing the trial, this Court is of the opinion that the petitioner deserves to be given adequate opportunities to that effect.
6. Therefore, all the orders directing issue of NBWA against the petitioner Raju Panika in connection with Sessions Case No.59/2023 are set aside.
7. The petitioner Raju Panika is directed to appear before the Trial Court of the learned Sub-Divisional Judicial Magistrate (Sadar), Lakhimpur, North Lakhimpur in connection with PRC Case No.12/2020 within next 10 (ten) days from today. On his appearance, he shall be released on bail of Rs.25,000/- (Rupees Twenty Five Thousand) with a surety of like amount to the satisfaction of the learned Sub-Divisional Judicial Magistrate (Sadar), Lakhimpur, North Lakhimpur.
8. With the aforesaid direction, the Criminal Petition stands disposed of accordingly.
