Apprehending arrest in connection with the Crime No.882 of 2026 registered with Ramnagar Police Station, Chandrapur for the offences punishable under Sections 340(2), 338, 336(3), 336(2), 61(2), 318(4), 316(5) of the Bharatiya Nyaya Sanhita (BNS), 2023, the applicant is seeking pre-arrest bail. 3. The informant was appointed as the Auditor and he audited Shri Sai Nagari Sahakari Pat Sanstha Maryadit, Chandrapur from 01/04/2023 to 31/03/2025. The audit reportedly revealed financial discrepancies and irregularities in the Society's records and transactions. Based on these findings, the Assistant Registrar directed initiation of criminal proceedings against persons associated with the Society's management and administration. The audit report shows misappropriation of Rs. 2,49,08,949/-. 4. Learned Counsel for the applicant submits that the main accused persons who are President, Vice 2026:BHC-NAG:11820 2 15.aba.758.2026 President and the Manager of the said society have already been protected by this Court as well as by the Sessions Court. The applicant is only an agent, who has collected the amount from the traders, which was deposited in the said society’s account and therefore, she has not siphoned the amount. He contended that the applicant has not played any role in misappropriation and therefore, the applicant prayed to be granted pre- arrest protection. 5. On the other hand, learned APP vehemently opposes the application on the ground that in the audit report, on the name of applicant liability of Rs.22,400/- has been fastened, however since the applicant had co- operated with the investigation after passing of the interim order, appropriate orders is prayed to be passed. 6. I have considered the rival submissions and perused the record. It appears that the applicant is only an agent and in the audit report for an meagre amount i.e. Rs.22,400/- a liability has been fastened on the applicant. Considering the above facts and circumstances of the case and role of the applicant, I am inclined to confirm the interim order granted by this Court, hence the following order : (a) Application is allowed and disposed of. (b) The order dated 24.08.2026 is hereby confirmed on the same terms and conditions as incorporated in the said order. (c) Pending application, if any, stands disposed of accordingly. 3 15.aba.758.2026 (d) The observations of this Court are prima facie in nature and are only limited to this application.
