Sinha, AC to GA.III ------ Order No.2 / Dated : 20.02.2026. Heard both the sides. The petitioner, above-named, who is in custody since 28.10.2025 in connection with C. I. D. P.S. Case No. 02 of 2025 for the offence(s) registered under Sections 316(2)/ 336(3) / 318(2)/ 318 (4)/ 61 (2)/ 324 (1) of the BNS, 2023 and Sections 12 (2) / 12 (3) of Jharkhand Competitive Examination (Prevention and Redressal of Unfair Means in Recruitment) Act, 2023 has moved for regular bail. It is submitted by the learned Senior counsel on behalf of petitioner that there is no allegation against him that he was involved directly in any unfair means in the examination. The allegation is that he was instrumental in spreading a fake narrative that there was a question paper leak which resulted in lodging the FIR being CID P.S. Case No.01 of 2025. It is further submitted that the petitioner had taken up this issue of paper leak, therefore, in counter-blast, the present case has been lodged against him. Petitioner had neither moved any competent authority nor lodged any FIR by giving any false information. The only allegation against him is that some questions purported to be leaked was forwarded by him the Dy. S. P. However, this allegation will not amount to any cognizable offence. Learned AC to GA.III for the State has vehemently opposed the prayer for bail. It is submitted that charge-sheet has been submitted in this case for the offence which include use of unfair means in examination against this petitioner. 2026:JHHC:5214 2 Charge-sheet in this case has been submitted on 19.01.2026 being Charge-sheet No.5/2026 against the petitioner and the copy of it has been filed by way of supplementary affidavit. From plain reading of the charge-sheet, it appears that the allegation is of not being involved in any paper leak, but spreading baseless rumour with regard to such paper leak so as to discredit the JSSC CGL Examination. Under the circumstances, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty-Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
