Case No.188 of 2020 dated 10.02.2020 under Sections 341/307/506/120B/115/34 of the Indian Penal Code and Sections 25/27 of the Arms Act. And In the matter of: Sourav Mondal @ Paltu Mondal ….Petitioner. Mr. Jyotirmoy talukdar …for the petitioner Mr. Bidyut Kr. Roy Mr. Kunal Ganguly … for the State Report filed on behalf of the State is taken on record. Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is absolutely innocent. He has been falsely implicated in this case. Learned counsel appearing on behalf of the State strongly opposes the prayer for anticipatory bail. He refers to the statement of an injured eye-witness who received a gunshot injury and identified the petitioner as one of the assailants who had attacked him. Reliance is also placed on the injury report and the statements of other witnesses. It is further submitted that the petitioner is a history sheeter. He has as many as three murder cases where he has been implicated, apart from other criminal cases. Considering the above and the incriminating materials available in the case diary and the criminal antecedents of the petitioner, I do not consider this to be a fit case for granting anticipatory bail. 2 The application for anticipatory bail is, thus, rejected. Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities. (Jay Sengupta, J.)
