The petitioner is apprehending his arrest in connection with Tandwa P.S. Case No.68 of 2024 for the alleged offences registered under Sections 272, 273 and 290 of Indian Penal Code and Section 47(A) of Excise Act, pending in the Court of learned Judicial Magistrate 1st Class, Chatra. 3. Learned counsel appearing for the petitioner submits that the allegations are made that 40 liters of country-made mahuwa liquor has been recovered from the house of the petitioner. He further submits that the said liquor was kept for celebration. He then submits that the petitioner has got no criminal antecedent as disclosed in paragraph No.14 of the petition. 4. Learned counsel appearing for the State opposed the prayer 2026:JHHC:12018 --2-- A.B.A. No. 1947 of 2026 and submits that recovery is there of 40 liters of mahuwa liquor from the house of the petitioner. 5. Considering that the petitioner has got no criminal antecedent as disclosed in paragraph No.14 of the petition and it has been pointed out that the said liquor was kept for celebration and in that view of the matter the petitioner is directed to surrender before the learned Court within two weeks and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
