Learned advocate for the petitioner submits that the petitioner is in custody for 95 days and the subject matter of recovery in the present case is 25 kgs. of ganja from an ambulance. The other accused from whose possession the recovery was made has been granted bail and the petitioner happens to be owner of the ambulance. Learned advocate for the State opposes the prayer for bail. Having considered that there are 9 witnesses on whom prosecution intends to rely upon to prove its case and some time may be required, I am of the view that, without entering into the merits of the case, the petitioner be released on bail. 2 Accordingly, the prayer for bail of the petitioner is allowed. The petitioner, namely, Avirup Bhattacharjee shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned Judge, Special Court, under NDPS Act, Suri Birbhum. If on bail, the petitioner shall be physically present on each and every date fixed by the learned special court and shall not leave the district of Birbhum without prior permission of the learned special court. Accordingly, CRM(NDPS) 596 of 2026 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
