According to petitioner, he filed a suit for specific performance in the Court of Civil Judge (Senior Division), Ramnagar, Nainital, which is numbered as Civil Suit No. 39 of 2021. 3. Learned counsel for petitioner submits that petitioner filed an application for temporary injunction in said suit on 06.01.2021; however, said application has not been disposed of so far. Learned counsel for petitioner further submits that defendant to the suit has been duly served and he has also filed written statement. 4. Having regard to the fact that temporary injunction application is pending consideration for last more than five years, the writ petition is disposed of with a request to the Court concerned to make endeavour to consider and dispose of the application for temporary injunction on the next date fixed in the suit. If, for any reason it is not possible UKHC010104302026 2026:UHC:4911 for the Court to do so, then temporary injunction application shall be disposed of on any other date within four weeks thereafter, provided the defendant is represented.
