The petitioner is apprehending his arrest in connection with Kathikund P.S. Case No.47/2020, corresponding to G.R. No.1089/2020, registered for the offence under Sections 419, 420, 467, 468, 34 of the Indian Penal Code and Section 66(C), 66(D) of I.T. Act, pending in the Court of the learned Judicial Magistrate, 1st Class, Dumka. 3. Learned counsel appearing for the petitioner submits that the petitioner’s name has come on confessional statement of apprehended co- accused, namely, Julkar Ansari. He further submits that the petitioner is a Labourer. He then submits that ATM card as well as any amount has not been recovered from the possession of the petitioner and the amount has also not been transferred in the account of the petitioner. On these grounds, he submits that anticipatory bail may kindly be granted to the petitioner. 4. Learned counsel appearing for the State opposed the prayer and submits that the petitioner is associate and it has come in the case diary that Aftab Alam and Sarfaraj Ansari have handed over ATM cards of Labourers to the petitioner as well as to Anil Kumar Mandal and Rajesh Kumar Mandal and ( 2026:JHHC:11885 ) -2- A.B.A. No. 6468 of 2025 in lieu of that, they get sum of Rs.5,000/- for each of the ATM cards. On these grounds, he submits that anticipatory bail may not be granted to the petitioner. 5. The matter is arising out of cyber-crime. The allegations are made that ATM cards of labourers are being used for cyber transaction. It has also come in para 40 of the case diary that Aftab Alam and Sarfaraj Ansari used to hand over ATM cards of Labourers to the petitioner and in lieu of that, the petitioner used to get Rs.5,000/- for each ATM cards. 6. In the attending facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner and, as such, his prayer for anticipatory bail is, hereby, rejected. 7. Accordingly, this application is dismissed. 8. However, if the petitioner surrenders before the learned Court and prays for regular bail, the same will be decided by the learned Court in accordance with law without being prejudiced to this order.
