The petitioners are apprehending their arrest in connection with Gumla P.S. Case No.426 of 2025, for offence registered under section 303(2)/317(5) BNS, 2023 and section 4/54 of Jharkhand Minor Minerals Concession Rules, 2004 and section 7/9 of Jharkhand Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2017, pending in court of learned Chief Judicial Magistrate, Gumla. 3. Learned counsel for the petitioners submits that the petitioners happened to be drivers of two different tractors and so far as the tractor of petitioner no.2 is concerned, no sand has been recovered and that has come in the order of learned Sessions Judge and the allegations are made against the petitioner no.1 that 100 cft sand was loaded. She also submits that in the seizure list, there 2026:JHHC:6921 2 is no independent witness and the petitioners are having no criminal antecedent as disclosed in paragraph no.11 of the petition. 4. Learned State counsel opposes prayer and submits that allegations are there of illegally carrying the sand. 5. Considering that from the tractor of the petitioner no.2 no sand has been recovered and the allegations are there of recovery of 100 cft sand from the tractor of petitioner no.1 and both the petitioners are said to be drivers of two different tractors and it has been pointed out that there is no criminal antecedent of the petitioners as disclosed in paragraph no.11 of the petition, and in that view of the matter, both the petitioners, above named, are directed to surrender before learned court within two weeks from today and learned court shall release the petitioners, above named, on such terms and conditions as well as sureties as learned court may deem fit and proper. 6.
