GP FOR MUNCIPAL ADMN URBAN DEV The Court made the following: 3 ORDER:- This Court had allowed W.P.No.13404 of 2021 which was filed by the petitioner, aggrieved by the issuance of show-cause notice dated 06.03.2021 and confirmation order dated 05.07.2021. 2. The petitioner had filed O.S.No.811 of 2014 on the file of the learned Principal Senior Civil Judge, Kurnool, seeking the relief of specific performance against the vendor, suit was decreed and sale deed was executed in favour of the petitioner on 28.09.2015. The show-cause notice and confirmation order were issued on the ground that the petitioner does not have an approach road and without showing the approach road, the petitioner cannot be permitted to complete construction and reside there. This Court considered the judgment passed in C.R.Reddy Law College Employees’ Association V. Bar Council of India and others1 and held that the petitioner cannot be called upon to perform an impossible task. The entire compound of Coles College includes residential quarters meant for staff and each individual residential unit cannot be expected to have a separate earmarked road to the public road abutting the compound wall. On these considerations, the W.P.No.13404 of 2021 was allowed and the impugned proceedings were set aside. 3. The present writ petition is filed challenging the proposed action of revoking the building permit dated 24.06.2021. The show cause notice and the confirmation notice were set aside by this Court as such the impugned proceedings would also have to be set aside. 1 2004 SCC Online AP 560 4 4. On these observations, the Writ Petition is disposed of. There shall be no order as to costs.
