The petitioner is apprehending his arrest in connection with Chandil P.S. Case No.177 of 2025 for the alleged offences registered under Sections 317(5) and 3(5) of Bharatiya Nyaya Sanhita, 2023, Section 11(1)(A) of Prevention of Cruelty to Animals Act, 1960 and Sections 3/4(A), 5, 12 and 13 of Jharkhand Bovine Animal Prohibition of Slaughter Act, 2005 pending in the Court of learned Sub-Divisional Judicial Magistrate, Chandil. 3. Learned counsel appearing for the petitioner submits that the name of the petitioner has been falsely taken by apprehended co-accused and falsely stated that the petitioner has moved the bovine animals for sending from the State of Jharkhand to the State of West Bengal. He further submits that the petitioner has got no 2026:JHHC:11502 --2-- A.B.A. No. 1682 of 2026 criminal antecedent as disclosed in paragraph No.18 of the petition. 4. Learned counsel appearing for the State opposed the prayer and submits that the name of the petitioner has been taken by apprehended co-accused. 5. Considering that the only allegation is made against the petitioner that he is instrumental in sending bovine animals from the State of Jharkhand to the State of West Bengal and apart from that there is no allegation and the name of the petitioner has come in the confessional statement of co-accused and the petitioner has got no criminal antecedent as disclosed in paragraph No.18 of the petition and in that view of the matter the petitioner is directed to surrender before the learned Court within two weeks and the learned Court shall release the petitioner on such terms and conditions or the sureties as the learned Court may deem fit and proper.
