For Petitioner(s): M/s.R.Krishnaswamy For Respondent(s): M/s.Kavya, Standing counsel, for R1 __________ Page1 of 4 https://www.mhc.tn.gov.in/judis WP No. 11590 of 2026 ORDER The writ petition has been filed to issue a writ of mandamus to the respondents to pay the petitioner interest for the belated payment of IRT contributions, Provident Fund, Gratuity, Earned Leave Salary and commuted value of pension at the rate of 12% per annum within a time frame to be fixed by this Court. 2. The case of the petitioner is that he was appointed as a Junior Tradesman in the 1 st respondent-Transport Corporation on 25.10.1982 and retired from service as Foreman on attaining the age of superannuation on 30.06.2019. However, the terminal benefits have been settled to the petitioner only on 28.12.2021 and no interest has been paid for the delayed period. Therefore, the petitioner had submitted a representation to the first respondent dated 24.02.2026, to pay the interest for the delayed period. Since the same was not considered, the present writ petition has been filed. 3. The learned Standing Counsel for the first respondent would fairly submit that the first respondent is willing to pay the interest at the rate of 6% per annum for the belated payment of the eligible and admissible amount. __________ Page2 of 4 https://www.mhc.tn.gov.in/judis WP No. 11590 of 2026 4. Heard the learned counsel for both sides and perused the materials available on record. 5. In view of the above submission of the learned Standing Counsel, this Court deems it appropriate to direct the first respondent to pay interest at the rate of 6% per annum for the belated payment of admissible terminal benefits from the date of retirement till the date of actual disbursal of the terminal benefits of the petitioner, within a period of eight weeks from the date of receipt of a copy of this order. 6.
