1. These criminal appeals under Section 14A of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (hereinafter to be referred as 'the SC/ST Act’) has been filed on
[2026:RJ-JP:21352] (2 of 3) [CRLAS-1095/2026] behalf of the appellants being aggrieved with the order dated 11.05.2026 passed by the learned Special Judge S.C./S.T. (Prevention of Atrocities Cases), Deeg (hereinafter to be referred as ‘trial court’) in FIR No. 71/2023 registered at Police Station Kama, District Bharatpur for the offence under Sections 364-A and 120 IPC and later on added Sections 323, 342, 364-, 120-B IPC and Sections 3(1)(R), 3(1)(S), 3(2)(va) and 3(2)(v) of SC/ST Act whereby the trial court has dismissed the bail application filed on behalf of the appellants.
2. Heard the learned counsels for the appellants as well as learned Public Prosecutor and perused the material on record.
3. None puts in apperance on behalf of the complainant despite service.
4. Learned counsels for the appellants submit that the appellants have falsely been implicated in this case. They further submit that the allegation levelled against the present appellants pertains to the abduction of the son of the complainant Lakhpat Singh. They submit that the names of the appellants have not been mentioned in the FIR and that no specific act has been attributed to them. They contend that co-accused Jhamman Singh has been enlarged on bail by Co-ordinate Bench of this Court vide
order dated 25.01.2024. Other co-accused Ramvir has been enlarged on bail by trial Court itself on 04.10.2025. The appellants are in custody since 05.05.2026 and 01.05.2026 respectively without any criminal past. Therefore, the appeal presented by the present appellants may be allowed.
5. Learned Public Prosecutor has vehemently opposed the
[2026:RJ-JP:21352] (3 of 3) [CRLAS-1095/2026] appeals filed by the appellants.
6. Considering the facts and circumstances of the case and without commenting anything on the merits/demerits of the case, I deem it just and proper to allow the appeal filed by the appellants under Section 14-A of SC/ST Act.
7. Accordingly, this criminal appeal filed under Section 14-A of SC/ST Act is allowed and order dated 11.05.2026 passed by the learned trial court is set aside. It is directed that appellants- Akhtar S/o Shri Alisher and Ravi Kumar S/o Ballo Singh @ Balbir shall be released on bail provided each of them executes a personal bond in a sum of Rs.50,000/- with two sound and solvent sureties of Rs.25,000/- each to the satisfaction of learned trial court for their appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
