Apprehending arrest in connection with the Crime No.230 of 2026 registered with Tamgaon Police Station, Buldhana for the offences punishable under Sections 108, 80, 3(5) of the Bharatiya Nyaya Sanhita (BNS), 2023, the applicants are seeking pre-arrest bail. 3. The FIR came to be lodged alleging that due to the harassment at the hands of the applicants, the deceased, who is the daughter in law of the applicants, committed suicide by hanging herself at the matrimonial house. 4. The applicants are father-in-law, mother-in-law and brother-in-law of the deceased, respectively against whom, according to the learned Counsel for the applicants, there are general and vague allegations of harassment. He submits that the applicants were not residing along with the deceased and her husband and had no concerned with the deceased. Therefore, considering the nature of allegations against the 2026:BHC-NAG:11819 2 14.aba.741.2026 applicants, pre-arrest protection is prayed to be granted. 5. On the other hand, learned APP vehemently opposed the application on the ground that FIR itself shows the role of the applicants, ill treatment and harassment given by them, due to which the deceased committed suicide and therefore, as there is sufficient material available against them, the application is prayed to be rejected. 6. I have considered the rival submissions and perused the record. It appears that this Court has granted interim protection to the applicants vide order dated 17.08.2026. As was submitted by the learned APP that the applicants have complied with all the conditions imposed by this Court while granting interim pre-arrest protection to the applicants. Perusal of the case diary, FIR and the statement of the witnesses shows that the deceased was harassed at the hands of the applicants, however it is to be noted that the applicants are residing separately, which is necessary to be considered and therefore, in my opinion, mere allegations of abetment of suicide are not sufficient to reject the pre-arrest protection. 7. Considering the above facts and circumstances of the case, I am inclined to confirm the interim order granted by this Court, hence the following order : (a) Application is allowed and disposed of. (b) The order dated 17.08.2026 is hereby confirmed on the same terms and conditions as incorporated in the said order. 3 14.aba.741.2026 (c) Pending application, if any, stands disposed of accordingly. (d) The observations of this Court are prima facie in nature and are only limited to this application. The Trial Court shall not be influenced by the aforesaid observations. (M.M.
