1. The applicant has filed this application for condonation of delay of 195 days caused in filing of the application for restoration of the appeal.
2. The learned counsel for the appellant submits that he had shifted his office from Mumbai to Nagpur and, during the said period, due to an oversight on the part of his clerk, the office objections could not be noticed. Consequently, the objections could not be removed within the stipulated period, resulting in delay in filing the application for restoration of the appeal. Kavita 2026:BHC-NAG:11313

3. Considering the reasons given in the application , the application is allowed and the delay caused in filing the application for restoration of the appeal, is hereby condoned, subject to the payment of costs of Rs.5,000/- to be deposited in

2. This is an application for restoration of the Second Appeal, which was dismissed in default by the Registrar (Judicial) for non removal of office objection.

As the conditional order was passed, the appeal was dismissed in default and considering the reasons given in the application, the application is allowed and the appeal is restored to it’s original stage, subject to the appellant removing the office objection, within a period of two weeks form today.
