This is Second bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant in Crime No. 264/2025 registered at Police Station Mulmula, District Janjgir Champa (CG) for the offences under Sections 137(2), 61(2), 62, 140(2), 142 of the BNS and Sections 25 & 27 of the Arms Act. 2. The first bail application has been dismissed on merits by order dated 01.12.2025 passed in MCRC No. 9406 of 2025. As per the prosecution case, the complainant lodged a missing report of his boy Samrat Tandon, on which, FIR was initially registered u/s 137(2) of BNS against unknown persons. During investigation, it is found that on 25.08.2025 present applicant along-with other accused persons have kidnapped the victim and demanded a ransom of Rs.10 lakhs. The further allegation is that the applicant and other accused persons have conspired to commit murder of the victim and bury his body in the jungle after receiving the ransom. On the basis of memorandum statement of co- accused Rahul Tandon, victim was recovered. 4. Learned counsel for the applicant submits that the applicant is not involved in the crime; there is no evidence available against the applicant to connect him in crime in question and based on mere suspicion, he has been arrested. He submits that the applicant is in jail since 27.08.2025; till date out of 29 witnesses, only 9 have been examined and there is no immediate possibility of disposal of the case, therefore, the applicant may be enlarged on bail. 5. Per contra, learned State Counsel opposes the bail application and submits that the applicant along with other co-accused persons have kidnapped the victim and demanded a ransom of Rs.10 lakhs from the his parents. He submits that the charge sheet has been filed on 24.10.2025. 6. Having considered the submissions made by learned counsel for the parties; the over all facts and circumstances of the case and looking to the nature of allegations made against the applicant, I am not inclined to release the applicant on regular bail.
