DATED :- 9th September, 2026 P.C.: By this application, Applicant seeks relaxation of condition of bail, which was granted vide order dated 19.06.2025 passed in Criminal Application (Bail) No.27/2025. 2. Applicant is accused in Crime No.39/2025 registered with Mandrem Police Station. Applicant is alleged to have aggressively approached victim and others with a wooden log and had abused them with filthy language and threatened to hit them on the head. Thereafter, Applicant hit victim, Mr. Bhagyesh Nagoji on his head, causing him serious head injury. Applicant was arrested in pursuance of the aforesaid crime. He moved Criminal Application 9th September, 2026 907 CRMA 215 2026 (Bail) No.27/2025 before this Court, which came to be allowed on certain conditions. Applicant seeks modification of condition no.'c', which reads thus: "(c) The Applicant shall not enter the village of Mandrem until the disposal of the Sessions Case in Crime No.39/2025 bearing chargesheet No.52/2025." 3. Learned Advocate appearing for Applicant submits that Applicant has abided by all the terms and conditions of this bail till date. He has attended the Sessions Court on all the dates till now. He states that charge is not framed and trial is likely to take much more time. It is submitted that Applicant has a business which has been badly hampered since he is required to stay away from village Mandrem. 4. Learned Additional Public Prosecutor strongly opposes the application and points out that the condition was incorporated with a specific reason to ensure the safety of the victim. 5. Upon consideration of the material tendered into service and the submissions advanced by learned Advocates appearing for the respective parties, this Court finds that Applicant has abided by all the conditions incorporated in the bail order dated 19.06.2025 till this date. There is no complaint of any conduct which would 9th September, 2026 907 CRMA 215 2026 prejudice the fair trial. Till this date, the charge is not framed. Apparently, the Trial Court would take much time. 6. In that view of the matter, this Court finds that prayers in this application can be considered. In the result, the application is allowed in terms of prayer clause 'A'. Applicant shall abide by all other conditions incorporated in bail order dated 19.06.2025. S. G.
