JUSTICE S.G.PANDIT) Petitioner is before this Court questioning the order dated 22.01.2026 in Application No.83/2026 passed by the Karnataka State Administrative Tribunal, Bengaluru (for short ‘Tribunal’) whereunder, the petitioner’s interim prayer to stay the order of suspension dated 30.08.2025 (Annexure-A7) as well as order of transfer dated 10.12.2025 (Annexure-A12), is rejected. 2. Heard Sri. Chandrakant R Goulay, learned counsel for petitioner and Sri. Vikas Rojipura, learned AGA for respondent Nos. 1 to 3. - 3 - HC-KAR NC: 2026:KHC:12035-DB WP No. 3230 of 2026 3. The petitioner was before the Tribunal in the above stated application questioning the order of suspension dated 30.08.2025 as well as order of transfer dated 10.12.2025. The petitioner also sought stay of both order of suspension as well as order of transfer. 4. The Official Memorandum dated 10.12.2025 transferring the petitioner would indicate that on revocation of order of suspension, the petitioner is posted to work as Nursing Officer to Primary Health Center – Chikkamudiwadi, Kanapakapura Taluk. As the suspension of the petitioner is revoked, the question of staying the suspension Order would not arise. Insofar as transferring and posting the petitioner as Nursing Officer to Primary Health Center, Chikkamudiwadi, Kanakapura Taluk is concerned, it is the subject matter of application before the Tribunal and it is for the Tribunal to examine the correctness or otherwise of the Official Memorandum of Transfer dated 10.12.2025. At this length of time, it may not be appropriate for this Court to go into the interim - 4 - HC-KAR NC: 2026:KHC:12035-DB WP No. 3230 of 2026 prayer of the petitioner to stay of transfer order dated 10.12.2025. 5. Learned counsel for the petitioner has raised several grounds in the writ petition. If those grounds are considered at this stage, it would affect both the petitioner as well as respondents, that too, when the main matter is pending before the Tribunal. Therefore, at this stage, we refrain from interfering with the interim order passed by the Tribunal. All contentions are left open and writ petition stands disposed of.
