This is an application under Section 483 of the BNSS, 2023 whereby the petitioner, namely- Md. Abdul Motin has prayed for releasing him on bail after he was arrested in connection with Samaguri P.S. Case No.130/2026 under Sections 303(2)/ 317(2)/ 317(4) of the BNS, 2023. 3. The allegation brought against the present petitioner is that he was in possession of 10 numbers of stolen cows. 4. The record shows that the original owner of the cows had kept those cows in the house of the petitioner. The cows are given in zimma of the original owner and the original owner was given anticipatory bail by the court below. 5. I have considered the submissions made by the learned counsels for both sides. 6. The petitioner is in custody for the last 17 days. 7. Mr. Parasar has objected to the bail prayer. 8. Since, the so-called stolen cows are already given in custody of its original owner, the present petitioner no longer deserves to bed detained in custody. His bail application is allowed. 9. The petitioner, namely- Md. Abdul Motin who was arrested in connection with Samaguri P.S. Case No.130/2026 under Sections 303(2)/ 317(2)/ 317(4) of the BNS, 2023, shall be released on bail of ₹25,000/- with a surety of like amount to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Kaliabor.
