Petitioner has challenged order dated 26.10.2018, passed by District Magistrate/Licensing Officer, Dehradun, whereby license for retail sale of country liquor granted to petitioner during Financial Year 2018-2019, was cancelled, and it was provided that the loss, if any, incurred by the Government in resettlement of the license, shall be recoverable from petitioner. 3. Learned State Counsel submits that order passed by District Magistrate/ Licensing Officer is appealable under Section 11 of Excise Act before the Excise Commissioner. 4. This Court finds substance in the submission made by learned State Counsel. 5. Since the order is passed by District Magistrate/Licensing Officer, therefore petitioner has remedy of filing appeal before the Excise Commissioner. 2026:UHC:4843 6.
