JUSTICE PARTHIVJYOTI SAIKIA ORDER Date : 01.06.2026 Heard Mr. N Sarkar, the learned counsel appearing for the petitioners. Also heard Mr. R J Baruah, the learned Additional Public Prosecutor appearing for the State of Assam. 2. This is an application under Section 483 of the BNSS, 2023, whereby the petitioners, namely, Anil Barman and his sons, namely, Dharani Kanta Barman and Hari Barman @ Dipak Barman have prayed for releasing them on bail after they were arrested in connection with Bongaigaon P.S. Case No.56/2026. 3. On 10.04.2026, at about 11 A.M., there was a quarrel between the petitioners and the informant lady. In the quarrel, the petitioners had a physical altercation with the son of the informant Lakhan Barman. It is alleged that during scuffle, the petitioner No. 1 Anil Barman also pushed a 70 year old mother-in-law of the informant, as a result of which, she sustained fatal injuries on her head and other parts of the body. Thereafter, the mother- in-law of the informant was taken to the hospital, where she died. 4. Mr. Baruah has submitted there is a prima facie case against the petitioner No.1 Anil Barman for whom the old lady died. 5. I have considered the submissions made by the learned counsel of both sides. I have decided to agree with Mr. Baruah that there are some incriminating materials against the petitioner Anil Barman in the case diary. Therefore, the prayer for bail of the petitioner No.1 Mr. Anil Barman stands rejected. 6. However, the materials against the petitioner No. 2 Dharani Kanta Barman and petitioner No. 3 Hari Barman @ Dipak Barman in the case diary are very Page No.# 3/3 scanty. Therefore, their prayer for bail is allowed. 7. It is hereby directed that the petitioner No. 2 Dharani Kanta Barman and petitioner No. 3 Hari Barman @ Dipak Barman shall be released on bail of ₹25,000/- each with sureties of like amount to the satisfaction of the learned Chief Judicial Magistrate, Bongaigaon.
