Item- 173. sg 24-02-2026 Ct. 19 WPA 3682 of 2026 Noor Hossain Mondal @ Nur Hossen Mandal Versus State of West Bengal & Ors. Mr. Niladri Sekhar Ghosh Ms. Labani Sikder Mr. Souvik Dey …for the petitioner Mr. Sekhar Mustaphi Ms. Debangana De Nayak …for the State Mr. Pradip Kumar Roy Mr. Asish Dutta …for the respondent nos.4&5 The petitioner alleges that the respondent no.7 is acting illegally by not extending the loan facility to the petitioner, who claims to be a member of Kangoi-Degeria Samaboy Krishi Unnayan Samity. The learned Advocate appearing for the petitioner submits that in the earlier years i.e. in the year 2023-24, the respondent no.7 did not extend the loan facility in favour of the petitioner for which the petitioner was compelled to approach the third respondent and it was only after the intervention by the third respondent, the 7th respondent extended the loan facility to the petitioner for the year 2023 and 2024. The learned Advocate appearing for the petitioner submits that the petitioner also applied for extending the loan facility in the year 2025 but till date, the 7th respondent has not extended the loan facility in favour of the petitioner. The petitioner submitted a representation before the 7th respondent dated 18th December, 2025 requesting him to extend the financial assistance to the petitioner without any delay. The learned Advocate for the petitioner submits that in spite of receipt of such representation, the 7th respondent has not communicated its decision to the petitioner till date. The State and the respondent nos. 3 and 4 are represented through their respective leaned Advocates. Affidavit of service filed in Court is taken on record. The learned Advocate for the petitioner submits that the 7th respondent has duly been served. However, none appears on behalf of the respondent no.7. In the light of the submission made by the learned Advocate for the petitioner and without entering into the merits of the claim made in the representation dated 18th December, 2025, WPA 3682 of 2026 stands disposed of by directing Manager, Kangoi-Degeria Samaboy Krishi Unnayan Samity, being the 7th respondent to consider the representation of the petitioner dated 18th December, 2025 and to dispose of the same by passing a reasoned order after affording an opportunity of hearing to the petitioner and communicate the reasoned order to the petitioner as expeditiously as possible but positively within a period of four weeks from the date of receipt of a server copy of this order along with a copy of the representation dated 18th December, 2025. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. 2 (Hiranmay Bhattacharyya, J.) 3
