Heard learned counsel for the petitioner and the learned Assistant Government Pleader for Panchayat Raj and Rural Development appearing for the respondents. 5 3. Case of the petitioner is that he is a contractor undertaking civil works in Kurnool District. Pursuant to contracts awarded under MPLADS and GP Funds for construction of a 40 KL OHSR at Ramapuram Village, Owk Mandal, and augmentation of the Single Village Scheme to the SC locality of Kalavatala Village, Kolimigundla Mandal, he completed the works within the stipulated time. According to the petitioner, the respondent authorities released the final bills after due quality checks but failed to refund an amount of Rs.1,80,000/- towards Earnest Money Deposit (EMD) and Further Security Deposit (FSD), though the same ought to have been released along with the final bills. 4. It is the case of the petitioner that, despite submitting representations requesting release of the security deposit amounts, the respondents have not taken any action. Alleging that the respondents are illegally withholding the security deposit without any authority of law, the petitioner has filed the present writ petition seeking a direction to the respondents to refund the amount of Rs.1,80,000/- along with consequential reliefs. 6 5. Learned Assistant Government Pleader for Panchayat Raj and Rural Development, on written instructions, from the Executive Engineer, RWS & S(P) Division, Nandyal- 5threspondent, submits that there is no dispute with regard to the execution of the subject works by the petitioner. He further submits that the petitioner is entitled to an amount of Rs.1,80,000/- towards Earnest Money Deposit (EMD) and Further Security Deposit (FSD), and that proposals for release of grant were submitted to the authorities concerned, and sought time for payment of the said amount. The written instructions are placed on record. 6. Having regard to the fact that there is no dispute with regard to the works executed by the petitioner and an amount of Rs.1,80,000/- towards Earnest Money Deposit (EMD) and Further Security Deposit (FSD) payable to him, and in view of the submissions of the learned Assistant Government Pleader for Panchayat Raj and Rural Development, the respondent authorities are directed to pay a sum of Rs.1,80,000/- to the petitioner within a period of six (6) weeks from the date of receipt of a copy of this order. 7 7. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
