Learned High Court Government Pleader takes notice for the respondent/Deputy Commissioner.

Learned counsel for the petitioner submits that at the instance of the petitioner, the Tahsildar, Chitradurga Taluk initiated action against the persons who had encroached upon a cart road and the said persons filed writ petition in W.P.No.13753/2023 raising a challenge to the notice issued by the Tahsildar. The petitioner herein was arrayed as respondent No.4 in the said proceedings. However, this Court disposed of the Writ Petition No.13753/2023 on 08.09.2025 while directing the Deputy Commissioner to dispose of the pending proceedings initiated at the behest of the petitioner. After the disposal of the writ petition, the petitioner gave one more representation as found at Annexure-A to the Deputy

Commissioner to remove the encroachment, but the Deputy Commissioner has not taken any action.

Consequently, the writ petition stands disposed of with a direction to the respondent/Deputy Commissioner, Chitradurga District to comply with the directions issued by this Court in W.P.No.13753/2023 and while considering the representation given by the petitioner at Annexure-A in accordance with law and as expeditiously as possible and at any rate within a period of two months from the date of receipt of a copy of this order.
Ordered accordingly.
Learned High Court Government Pleader is permitted to file memo of appearance within a period of four weeks from today.
