The District Collector, Ananthapuram District at Ananthapuram. ...Respondents Counsel for the Petitioner: S KRISHNA REDDY Counsel for the Respondents: GP FOR SERVICES II Counsel for the Respondents:K VISWANATHAM (SC FOR APSRTC) The Court made the following order: 2 THE HONOURABLE SRI JUSTICE BALAJI MEDAMALLI WRIT PETITION NO: 20331/2023 ORDER: This writ petition is filed seeking to declare the inaction of the respondent Nos.1 to 3 in appointing the petitioner in any suitable post on compassionate grounds under bread winner scheme, consequent upon the death of his deceased father Shaik Masthan, who worked as a driver in APSRTC, Kadiri Depot, Sri Satya Sai District as illegal and arbitrary. 2. Heard learned counsel for the petitioner, learned Standing Counsel for APSRTC, and learned Assistant Government Pleader appearing for respondents. 3. The case of the petitioner is that father of the petitioner, Shaik Masthan, died on 16.03.2016 due to heart attack while he was working as a Driver in APSRTC, Kadiri Depot. Thereafter, the petitioner made a representation to the 2nd respondent on 09.06.2022 requesting employment on compassionate grounds, stating that he possesses the requisite qualifications. However, respondent Nos.2 and 3 have kept the said application pending without consideration. 4. Aggrieved by the inaction, the present writ petition is filed. 5. The respondent filed counter affidavit stating that there is a rival claim pending with regard to terminal benefits of the deceased employee filed by 3 one Shaik Vaheeda in O.S.No.146 of 2016 on the file of learned Civil Judge (Senior Division), Kadiri against family members of the petitioner. In view of the pendency of the dispute in the Court, the selection committee, Ananthapuramu Region, did not consider the representation of the petitioner and kept pending. 6. Learned counsel for the petitioner has placed on record the judgment dated 05.08.2025 in O.S.No.146 of 2016, whereby the terminal benefits of the deceased employee had been apportioned by the court as per the decree and judgment passed therein. 7. Considering the submissions made by the learned counsel on either side and on perusal of the record, it is evident that the suit in O.S.No.146 of 2016 on the file of learned Civil Judge (Senior Division), Kadiri has been disposed of by the trial court. In view of the disposal of the said suit, and as no dispute is now pending, the respondent authorities are required to consider the application filed by the petitioner for compassionate appointment. 8. Learned Standing Counsel for APSRTC has submitted that the District Collector is the competent authority to consider the applications for compassionate appointment in pursuance of G.O.Ms.No.22, dated 12.07.2022. 9. In view of the above, writ petition is disposed of, directing the 3rd respondent to consider the application of the petitioner forwarded to him and 4 pass appropriate orders within a period of three months from the date of receipt of a copy of this order.
