Petitioner has impugned the order of her transfer dated 10.06.2026 whereby the petitioner, who is working as Supervisor with the respondent Department, has been transferred from Bal Vikas Pariyojna, Rudrapur (Rural), District U.S. Nagar to Bal Pariyojna Office, Bhaisiyachhana, District Almora. 4. The transfer order is challenged by the petitioner on the ground that out of total service of 30 years, 11 months and 02 days, petitioner has served in inaccessible area for a period of 26 years, 06 months and 29 days. Still the petitioner has been transferred from Rudrapur where she joined on 07.01.2022 after being transferred from a remote and inaccessible area. The petitioner submits that transfer of petitioner is against the provisions of Uttarakhand Annual Transfer for Public Servants Act, 2017. 5. From a perusal of the record, the contentions raised by learned Counsel for the petitioner found support. The petitioner has put in more than 26 years of service in inaccessible areas. Therefore, this Court is inclined to interfere in the matter. 6. Petitioner has submitted a representation to respondent no.2-Director, Women Empowerment and UKHC010106732026 2026:UHC:5002 Child Development Department, Uttarakhand Dehradun on 11.06.2026 which is made part of record as Annexure No.5. 7. In view of the facts and circumstances of the case, the writ petition is finally disposed of. The respondent no.2 is directed to consider and decide the representation of petitioner dated 11.06.2026 (Annexure No.5) by a speaking order considering the fact that the petitioner has already completed 26 years, 06 months service in inaccessible area. The representation be decided within two weeks from today. 8. Till the representation is decided, effect and operation of impugned transfer order dated 10.06.2026 shall remain stayed. 9. Let a copy of this order be supplied to learned Counsel for the parties today itself as per rules. 10. Pending application, if any, stands disposed of. (Pankaj Purohit, J.) 17.06.2026 R.Dang
