Requisition notice before the prescribed authority filed by the private respondents is taken on record. The petitioner who is the Pradhan, Sahebnagar Gram Panchayat seeks cancellation/withdrawal of the notice of motion dated 2nd April, 2026 on the ground that it has been issued in violation of Sections 12(2) and 12(3) of the West Bengal Panchayat Act, 1973. Such contention has been denied and disputed by the respondents who initiated the no confidence motion. It appears that the motion was received by the prescribed authority on 27th March, 2026 and upon satisfaction that it conformed to the requirement of sub section (2), the notice of convention of the meeting was issued within five working days on receipt of the motion in terms of Section 12(3) of the Act. The meeting was convened on 13th April, 2026. In view of the above, this Court is inclined to hold that the entire procedure was conducted by the prescribed 2 authority in terms of Section 12 of the Act and there is no illegality or irregularity therein which calls for interference by this Court. The writ petition is devoid of any merit and is accordingly dismissed. There shall however, be no order as to costs. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Suvra Ghosh, J.)
