APP Mr. Nirupam Dhali …for the State Learned counsel appearing on behalf of the petitioner submits that this is a third application for anticipatory bail. A charge sheet has been filed in 2026. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He submits that the petitioner’s first application for anticipatory bail was rejected in 2019 and the second application was rejected in 2021, with imposition of a cost of Rs. 10,000/- for non-disclosure of a material fact. There is no change in circumstances to warrant a fresh application for anticipatory bail. Filing of a report in final form is a natural consequence of initiation of a criminal proceeding. Moreover, it does not appear that the provisions present in the charge sheet are in any manner less than those which were present in the FIR. Considering the above and there being no material or substantial change in circumstances, the third application for anticipatory bail is dismissed as not maintainable. 2 Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
