The present appeal has been filed against the order dated 09.10.2017 passed by the learned Additional Sessions Judge-cum-Special Judge, Simdega in connection with Spl. Case (SC/ST) No.03 of 2017, arising out of Simdega SC/ST P.S. Case No.01 of 2017, corresponding to G.R Case No.10 of 2017 whereby and whereunder cognizance has been taken under Sections 323, 324, 420, 506/34 of the Indian Penal Code and Section 3(v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. Now, the case is pending before the Court of learned Additional Sessions Judge-cum-Special Judge, Simdega. 3. The prayer for bail of the appellant was earlier rejected by this Court. It appears that the amount has already been deposited. 4. Learned counsel for the appellant seeks permission to withdraw the present criminal appeal with a liberty to approach before the learned Trial Court. 5. The appellant is directed to surrender within a period of four weeks from today before the Trial Court and the Trial Court is directed to take a decision on the same day on the basis of compromise petition. 7.
