Petitioner has challenged order dated 06.07.2022, passed by learned Civil Judge (Junior Division), Kotdwar, District Pauri Garhwal in Civil Suit No. 55 of 2022. By the said order, temporary injunction application filed by the petitioner was rejected. Petitioner preferred appeal against the said order, which too was dismissed by learned Additional District Judge, Kotdwar, Pauri Garhwal, vide order dated 27.01.2023. Challenging these to judgment and orders, petitioner filed this writ petition in the year 2023. 4. As per information received from Civil Judge (Junior Division), Kotdwar, vide letter dated 04.08.2025, Civil Suit No. 55 of 2022 was dismissed on 03.02.2024. 5. Learned counsel for the petitioner was asked to get instruction as to whether any application seeking restoration of the suit was filed or not. He submits that due to illness, plaintiff could not file any restoration application in the said suit. 6. Since the suit itself has been dismissed long back, therefore, no useful purpose would be served by keeping this writ petition pending. 7. Accordingly, the writ petition is dismissed as infructuous.
