1. Both the ABLAPLs are disposed of by the following common order.
2. Heard learned counsels for the petitioners and State.
3. Instant petitions have been filed under Section 482 BNSS by the petitioners seeking pre-arrest bail in connection with Bolagarh P.S. Case No.207 of 2025 corresponding to G.R. Case No.701 of 2025 pending in the court of learned J.M.F.C.(Cog. Taking), Khordha on the grounds stated.
4. Perused the FIR as at Annexure-1. The bail orders of co-accused persons are at Annexure-2. Learned counsels for the petitioners submit that the name of the petitioners have not been mentioned in the FIR, hence, they should be treated equally like the co-accused persons, who are on bail. Perused the bail orders at Flags-A and B. In fact, the co-accused persons have been granted bail in the meantime. One of the accused persons, namely, Ganeswar Samantasinghar was released by the Court’s order dated 12th January, 2026 extending parity as he was similarly situated like the other accused persons, who were granted bail by the Court’s order dated 3rd December, 2025 as at Annexure-2 (Flag-A).

Learned counsel for the State, on the other hand, opposed the release of the petitioners and claims that the victim received grievous injury and refers to medical report produced along with the case diary and all other relevant documents including the statements of the witnesses. On a reading of the statements of the witnesses examined during investigation, it is made to reveal that the alleged incident took place, as a result of which, the victim received injury. The Court further finds that in the meantime, the chargesheet is filed on 10th December,
2025. The names of the petitioners are not mentioned in the FIR i.e. Annexure-1 as rightly pointed out by learned counsel appearing for them. Considering the above facts, objection of the State and release of the co-accused persons vide ABLAPLs, the Court is inclined to apply parity and release the petitioners as well on similar terms and conditions.
6. Accordingly, it is ordered.
7. In the result, the ABLAPLs are disposed of with the direction as aforesaid. It is directed that in the event, the petitioners surrender before learned J.M.F.C.(Cog. Taking), Khordha in connection with Bolagarh P.S. Case No.207 of 2025 corresponding to G.R. Case No.701 of 2025 within a fortnight from today, they shall be released on bail upon furnishing bail bonds of Rs.30,000/-(rupees thirty thousand) each with one solvent surety for the like amount each with such other suitable conditions imposed as deemed just and proper in the facts and circumstances of the case.
