Mr. Manoj Tandon, learned counsel for the petitioners has submitted that these Contempt Petitions have been filed for non-compliance of the orders passed by this Court in the respective writ petitions. 3. Learned counsel for the State has submitted that the writ petitioners, who are Trained Teachers, are being paid on the basis of Trained Scale and the Teachers, who are un-trained, have not filed the necessary papers before the State Authorities and hence, they have not been paid till date, however, if the petitioners of these contempt petitions file the necessary papers before the State, then the benefits will be extended to them in the compliance of the orders passed by this Court in the respective writ petitions, however, the petitioners of these contempt petition, who are found to be Un-Trained during verification by the State Government, then their arrears of salary and pension will be fixed in accordance with law. 4. Learned counsel for the State has further submitted that they will not recover any amount, but the State is at liberty to pay the petitioners of this Contempt Neutral Citation No. ( 2026:JHHC:2183 ) -3- petitions in accordance with law which is found due till date. 5. In support of his submission, learned counsel for the State has placed reliance upon the Judgement dated 15.12.2020, passed in L.P.A. No. 442 of 2018 (State of Jharkhand Vs. Abdul Qayum & Anr. and other cases) and also in the case of State of Punjab v. Rafiq Masih reported in (2015) 4 SCC 334. 6. In view of the submissions made by the learned counsel for the parties, this Court is of the view that the petitioners of these contempt petitions should co-operate with the State Authorities and should fill up the necessary forms and the papers and the State Authorities, after proper verification will pay the amount in question in accordance with law to the petitioners. 7. Under the circumstances, this Court direct the State Authorities to pass necessary order with regard to the case of the petitioners of these Contempt petitions in the light of the judgments passed by this Court in the connected writ petitions, bearing W.P.(S) No.s 4602 of 2019, 5410 of 2019, 3919 of 2019, 4230 of 2019, 3107 of 2019, 1025 of 2019 and 5063 of 2019, as has been mentioned above. However, it will be open to the petitioners of these Contempt petitions to challenge Neutral Citation No. ( 2026:JHHC:2183 ) -4- the decision of the State Government if their grievances are not redressed. 8. Mr. Sachin Kumar, learned Counsel for the State has further assured and submitted before this Court that if any of the petitioners of these Contempt petition is found to be working in the Trained Scale, then State will pay the dues on the basis of Trained Scale, which may be subject to result of verification, preferably within two weeks from the date of receipt/production of this order. 9.
