The writ petition is filed with a prayer to set aside the impugned order passed by respondent No.1, vide Annexure-F to the writ petition, whereby the petitioner has been disqualified from his membership of Yalagatvalli Gram Panchayat. 3. Learned counsel for the respondents submits that the petitioner was functioning as the President of Yalagatvalli Gram Panchayat. On the ground that he was involved in misappropriation of funds, the proceedings were initiated against him and the orders have been passed under Sections 43A and 48 of the Karnataka Gram Swaraj and Panchayat Raj Act, 1993. It is submitted that the impugned order was passed on 28.01.2019. It is further submitted that subsequent to passing of the impugned order, the elections have been conducted in respect of the Yalagatvalli Gram Panchayat and also to the post of the President in the said Gram Panchayat. It is also submitted that the impugned order - 4 - HC-KAR NC: 2026:KHC:15696 WP No. 6043 of 2019 will have the effect of disqualifying the petitioner for a period of six years from the date of its passing and the said period has also lapsed. For that reason, it is submitted that the writ petition has become infructuous. 4. For the aforementioned reasons, the writ petition is dismissed as having become infructuous.
