The petitioner is apprehending his arrest in connection with Madhupur P.S. Case No. 144 of 2025, registered under sections 109(1)/351(2)/352 of BNS, 2023 and section 27 of Arms Act, 1959, pending in the Court of learned Additional Chief Judicial Magistrate, Madhupur, Deoghar. 3. Learned counsel for the petitioner submits that there is dispute regarding pump operation for water supply scheme of Karon Panchayat, Madhupur and for resolving the said dispute a meeting was held on 04.11.2025 in presence of Executive Engineer, Assistant Engineer, Junior Engineer of Drinking Water and Sanitation Department and several mukhias of other panchayat including informant and pursuant to that key of pump house was handed over to one Vishwajit Rawani for smooth running of pump house for water supply. By way of referring annexure-3 to the petition, learned counsel for the petitioner submit that the informant voluntarily compromised the case and a joint compromise petition has been filed in A.B.P. No. 349/2025 before the learned District & Sessions Judge-I at Madhupur. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail. ( 2026:JHHC:11883 ) 4. Learned counsel for the State opposes the prayer and submits that allegations are there of firing upon the informant and recovery of bullet is there. 5. A supplementary affidavit has been filed wherein minutes of meeting dated 04.11.2025 has been annexed and that meeting was held in presence of Executive Engineer, Assistant Engineer, Junior Engineer of Drinking Water and Sanitation Department and several mukhias of other panchayats including informant and pursuant to that key of pump house was handed over to one Vishwajit for smooth running of pump house for water supply. Annexure-3 is document which suggests that informant voluntarily compromised the case and a joint compromise petition has been filed in A.B.P. No. 349/2025. 6. In the attending facts and circumstance of the case the petitioner is directed to surrender before the learned court within two weeks from today and the learned court shall release the petitioner on terms and conditions and sureties as learned court deems fit and proper. 7.
