02/ 22.04.2026: Heard learned counsel for the petitioner and learned counsel for the State.
2. The petitioner is apprehending her arrest in connection with Borio (J) P.S. Case No. 293 of 2019 registered under section 379 of the Indian Penal Code, 1860, in addition to Rules 4 and 54 of Jharkhand Minor Minerals Concessions Rule (JMMC Rules), 2004, pending in the Court of learned Chief Judicial Magistrate, Sahibganj.

Learned counsel for the petitioner submits that petitioner is not named in F.I.R. He next submits that petitioner came to know about the case when she received notice under section 41-A Cr.P.C. He further submits that allegation is made against co-accused Ajay Kumar Yadav @ Pintu Yadav of doing illegal mining and he has been granted anticipatory bail by the Co- ordinate Bench of this Court in A.B.A. No. 4026 of 2021. He further submits that petitioner has got no criminal antecedent which is disclosed in para 24 of the petition. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits that the name of the petitioner has come during course of investigation.

Considering that petitioner is lady having no criminal antecedent
( 2026:JHHC:11722 ) and allegation of doing illegal mining is against co-accused who has been granted anticipatory bail in the aforesaid A.B.A by the Co-ordinate Bench of this Court and in that view of the matter, the petitioner is directed to surrender before the learned court within two weeks from today and the learned court shall release the petitioner on terms and conditions and sureties as learned court deems fit and proper.
6. This anticipatory bail application is disposed of.
