The learned counsel for the Petitioner, on instructions, seeks leave to withdraw the Petition with liberty to file separate Application for custody of the minor child. The learned counsel further submitted that the Petitioner had filed Divorce Petition and in the said Petition also prayer was made for custody of the minor child but learned Judge allowed the Divorce Petition and did not pass order regarding custody of the minor child. The minor child stays with the Respondent for last eight years. The Family Court shall decide Custody Application, if filed by the Petitioner as early as possible and preferably within six months after filing of the said Application. 5.
