Petitioners were appointed as Assistant Teacher, Primary School on 29.09.1993, 29.09.1993, 03.02.1997 and 14.03.1995 respectively. Thereafter, petitioners were promoted as Assistant Teacher, Junior High School/Head Mistress (Grade Pay Rs.4,600/-) after ten years of service on 25.05.2003, 26.05.2003, 07.07.1999 and 17.07.1999 respectively. Later on, petitioners were adjusted as Assistant Teacher, L.T. Grade (Grade Pay Rs.4,600/-) on 30.05.2009, 30.05.2009, 09.06.2009 and 16.07.2009 respectively. 4. Undisputedly, the selection grade was given to the petitioners after 10 years of regular service by adding the service rendered by them as Assistant Teacher, Junior High School/Head Mistress. Now, petitioners are before this Court seeking promotional pay scale i.e. Grade Pay Rs.5,400/-, inasmuch as, the said prayer of petitioners was rejected by the impugned order dated 15.05.2026. 5. Learned Counsel for the petitioner submits that petitioners have rendered 12 years of service on the post of Assistant Teacher, L.T. Grade (G.P. Rs.4600) and after completion of 12 years’ service, they were entitled to be sanctioned the promotional pay scale with effect from their date of respective entitlement. He further submits that the case of petitioners is squarely covered by judgments passed by this Court in WPSS No.281 of 2024 (Neelam Rawat v. State) decided on 29.02.2024 and WPSS No.737 of 2024 (Sudha Semwal v. State) decided on 08.05.2024, wherein similarly situated persons were granted the benefit of promotional pay scale. 6. Learned State Counsel do not dispute the said fact regarding the parity claimed by petitioners with the aforesaid two judgments passed by this Court. 7. Accordingly, the writ petition is allowed. The respondent no.3 is directed to grant the benefit of promotional pay scale to the petitioners (Grade Pay Rs.5,400/-) on completion of 12 years’ service from the date of their entitlement.
