THE HONOURABLE SMT JUSTICE V.SUJATHA CONTEMPT CASE NO: 6616 of 2023
ORDER:
This Contempt Case is filed for willful violation of the orders passed by this Court in W.P.No.37778 of 2017 on 25.01.2023, wherein this Court passed the following order:
“….Accordingly, this writ petition is disposed of, directing the petitioner to present the document and the 2nd respondent herein i.e., the Sub Registrar is directed to receive, process and release the document as and when presented by the petitioner as per the provisions of Section 71 of the Registration Act, 1908. In case, the instrument presented cannot be registered, the respondents shall pass appropriate orders as required under Section 71 of the Registration Act, 1908, as it is appealable under Section 72 of the Registration Act, 1908.…”
2. Sole respondent has filed counter-affidavit duly stating that the petitioner instead of presenting the documents for registration, has issued a legal notice and in view of the same the orders passed by this Court could not be complied with.
3. At the time of disposal of the main writ petition itself, it can be observed that, learned Government Pleader for Revenue has furnished the copy of instructions of the Sub Registrar, Sullurpet, S.P.S.R. Nellore District, wherein it has been specifically mentioned that the pending document Nos.P.91/2017 and P.92/2017 have been refused by the Sub Registrar, vide refusal order Nos.2/2020 and 3/2020 on 24.08.2020.
4. In view of the same, immediately after disposal of the writ petition, it is the responsibility of the petitioner to re-submit the documents so that they can be processed in pursuance of the orders passed by this Court. As the petitioner has failed to produce the documents, the question of non-compliance of the orders does not arise.
5. Recording the same, the Contempt Case is closed. There shall be no
order as to costs.
As a sequel, miscellaneous applications, pending, if any, shall also stand closed.
