The said application was rejected by learned Judge, Family Court, Dehradun, vide order dated 1.8.2022. Thus feeling aggrieved, petitioner has approached this Court challenging the order dated 1.8.2022. (3) Learned Counsel for the petitioner submits that since earlier suit on the ground of cruelty and desertion was dismissed by learned Family Court, therefore, subsequent suit for the same cause of action was not maintainable. (4) As per the communication received from Additional Principal Judge-1st, Family Court, Dehradun dated 30.7.2025, Original Suit No. 715 of 2021, Ajay Kumar Raman v. Smt. Rekha, was decided on 7.12.2024. (5) After decision in the suit, the challenge to the order, whereby petitioner’s application under Order 7 Rule 11 CPC was rejected, do not survive. Accordingly, writ petition is dismissed as infructuous.
